AGENDA 21 ON STEROIDS- "Say Goodbye to Property Rights".

With this they could take your property for WATER RUNOFF!

 

§ 10.1-1187.101. Power of eminent domain. In addition to any other powers conferred on it by law, any watershed improvement district organized under the provisions of this article shall be authorized to acquire by eminent domain any lands, property rights, franchises, rights-of-way, easements, or other property deemed necessary or convenient for the efficient operation of the district.Such proceedings shall be in accordance with and subject to the provisions of the laws of the Commonwealth applicable to the exercise of the power of eminent domain in the name of a public service company and subject to the provisions of Chapter 2 (§ 25.1-200 et seq.) of Title 25.1.

 

This bill goes to the House floor today. Things move so fast during session that many delegates probably do not know what they are voting on. Please call all Delegates and ask them to oppose HB2048

There is a reason why multiple Soil & Water Conservation Districts (directly elected) unanimously voted against this proposal in the fall as it was being pushed through the proposal process in a less than forthcoming manner.

 

 

 HB2048

Replaces DCR with DEQ and the Soil & Water Conservation Board with the State Water Control Board in regards to non-point source regulations. (lines 109-113)

Places the SWCD's (Soil and Water Conservation Districts) under DEQ while stripping them of any power to do anything other than "assist" the DEQ regarding non-point source pollution management. (lines 126-132)

Replaces DCR with DEQ in the Definitions (lines 160-162)

Localities are now beholden to DEQ rather than DCR in regards to storm water runoff abatement. (lines 374-375)
 
This bill would:

  1. Reduce the role of directly elected local Soil & Water Conservation Districts in protecting and working with landowners

  2. Increase the regulatory authority and power of the DEQ

  3. Further centralize power in Richmond as opposed to the localities affected

  4. Destroy the separation of power now enjoyed by the current split between the DCR and DEQ which has the blessing of protecting citizens from ill-formed and unintended consequences of decisions by any one agency.

  5. Give DEQ employees direct access to landowners' property under the guise of "voluntary" conservation practices

  6. Help further unfunded federal mandates upon the states and localities

  7. Kick the door wide open for Agenda 21 implementation, funding and ENFORCEMENT by DEQ

SPECIAL SECTION FOR FARMERS:

 

Here is just a sample of your United Nations Agenda 21 (EPA) Regulations:

Article 1.7. Resource Management Plans.

A. The Virginia Soil and Water Conservation Board shall by regulation, and in consultation with the Department of Agriculture and Consumer Services specify the criteria to be included in a resource management plan.

B. The regulations shall:

a. For all cropland or specialty crops, such components shall include the following, as needed and based upon an individual on-farm assessment:

(1) A nutrient management planthat meets the nutrient management specifications developed by the Department;

(2) A forest or grass buffer between cropland and perennial streamsof sufficient width to meet water quality objectives and consistent with Natural Resources Conservation Service standards and specifications;

(3) A soil conservation planthat achieves a maximum soil loss rate of "T," as defined by the Natural Resources Conservation Service; and

(4) Cover cropsmeeting best management practice specifications as determined by the Natural Resources Conservation Service or the Virginia Agricultural Best Management Practices Cost-Share Program.

b. For all hayland, such components shall include the following, as needed and based upon an individual on-farm assessment:

(1) A nutrient management plan that meets the nutrient management specifications developed by the Department;

(2) A forest or grass buffer between cropland and perennial streams of sufficient width to meet water quality objectives and consistent with Natural Resources Conservation Service standards and specifications; and

(3) A soil conservation plan that achieves a maximum soil loss rate of "T," as defined by the Natural Resources Conservation Service.

c. For all pasture, such components shall include the following, as needed and based upon an individual on-farm assessment:

(1) A nutrient management plan that meets the nutrient management specifications developed by the Department;

(2) A system that limits or prevents livestock access to perennial streams; and

(3) A pasture management plan or soil conservation planthat achieves a maximum soil loss rate of "T," as defined by the Natural Resources Conservation Service.

Article 1.5. Soil and Water Conservation Districts.

§ 10.1-1187.21. Power to create new districts and to relocate or define district boundaries; composition of districts.

§ 10.1-1187.68. Virginia Envirothon.

Districts in partnership with other districts, agencies, organizations, and associations are authorized to coordinate and implement the Virginia Envirothon Program, administered by the Virginia Association of Soil and Water Conservation Districts, which enables learning experiences for high school students through competitive events focusing on natural resource conservation.

Article 1.6. Watershed Improvement Districts.

§ 10.1-1187.79. Establishment within soil and water conservation district authorized.

§ 10.1-1187.101. Power of eminent domain. LEGISLATIVE UPDATE: 1-30-2013

 

HB1430 passed the House Committee on Agriculture, Chesapeake and Natural Resources with a re-enactment or delayed enactment clause for July 1, 2014. This means if the bill makes to the Governor's desk for his signature in this session, it must once again pass both houses and be signed into law in 2014 before it will be effective.

 

YEAS--Sherwood, Ware, R.L., Wright, Orrock, Scott, E.T., Marshall, D.W., Poindexter, Pogge, Knight, Edmunds, Wilt, Morefield, Webert, Ransone, Fariss, Lewis, Bulova, Sickles, James, Torian, Keam--21.

The fight to pass and enact this law on July 1, 2013 is not over and we will continue to stay on the frontlines and keep you up to date on HB1430.

HB2012 to place a moratorium of drones for a year passed the House House Courts of Justice Sub-Committee: #1 Criminal with the following amendments:

 

  1. The moratorium is for two years rather than one, extending it to 2015.

  2. Provides the Governor with use of drones in the event of an emergency.

 

YEAS--Bell, Robert B., Cline, Gilbert, Villanueva, Morris, Watts, Herring--7.

 

NAYS--Albo, Miller--2.

 

In May of last year, Governor McDonnell praised drone technology saying they are "great" and urged its use domestically for the same reasons it is deployed overseas.

 

Governor McDonnell should be held to the same standard as law-enforcement when it comes to unwarranted surveillance with the use of an unmanned drone. But McDonnell made it clear that he believes drones should not only be used domestically for surveillance, but to be used for the same reasons they are deployed overseas.

 

The Commonwealth of Virginia is not a combat zone. Why would any Governor be allowed to use armed unmanned drones against the citizens of Virginia?

 

Obama would be proud!

 

This is unacceptable and our legislators in the House need to hear our outrage loud and clear!

 

The bill is on its way to the full Committee on Courts of Justice and their next meeting is Friday, February 1, 2013.  

 

Please contact members of the committee and urge them to strike the provision that the Governor would have use of armed unmanned drones under any circumstances from HB2012.

 

We have a President with a kill list and weaponized drones at his disposal and he is all too willing to use them for whatever reason he sees fit. We don't need a Governor with them, too.

 

Tell them that the use of weaponized drones domestically is an act of war against the citizens of the Commonwealth.  

 

Law-enforcement has helicopters and planes at it's disposal in case of emergencies and drones are for combat, not domestic use.

The Energy Forum's purpose is to educate citizens about United States'

energy policy, regulation, economics, and infrastructure so that they are

better equipped to understand and evaluate proposed energy and environmental

policies and legislation. Specifically, the forum will address emerging

Virginia energy / environmental issues including the need for additional generation

capacity, offshore wind projects, SMART metering, and similar topics.

The forum will be divided into three segments.

  • Overview: Energy Sources, Infrastructure, Demand, and Supply
  • Generation: Regulation, Economics, and Environmental Impact
  • Virginia Specific Issues: Uranium Mining, Wind Farms, Smart Metering

Each segment will be preceded by a topical overview,

followed by a question and answer period.

Panelists include:

Dr. Randy Randol is a former nuclear engineer and ExxonMobil

environmental advisor in Washington, DC . M.S. and Ph.D. in Nuclear Engineering.

He advised the Bush administration on climate change matters.

Mr. Ken Haapala is the Executive Vice President of the Science and

Environmental Policy Project (SEPP).

He holds an M.S. in Economics and is a quantitative economist

who has created numerous mathematical models that simulate complex,

econometric phenomenon. In the 1970s, he accurately reported that government energy models significantly underestimated oil and US natural gas supply at the

end of the 20th century.

Mr. Kris Allen, P.E, PMP, is a Partner in Business Performance Group, Inc.,

and President of the Tidewater Chapter or Virginia Scientist

and Engineers for Energy and the Environment (VA-SEEE).

He holds degrees in Nuclear Engineering (B.S.) and High Energy Physics (M.S.).

For twenty years, he held executive positions in privately-and

publicly-held corporations that provided design modification, management ,

and information technology services to electric utilities

and the Department of Energy.

I enjoyed meeting you at the Smart Meter hearing Monday.  Thank you for dedication to Liberty and excellent summary of how you tried to impact the civil sphere of government.  Below, is what I posted to Facebook and Linked In from your article link.   I did  Tweet, the first two questions.

"What is Norment's role with Dominion Power,  stockholder? conflict of interest? Just prior to the hearing, Dominion Corporatist met with Sens. Edward, Alexander, and Saslaw left end of the Senator seats in what appeared to be the final defeat of the Smart Meter Bill. As they turned to exit the room, the totally white haired man in a long black coat gave a "thumbs up" with a smile on his face! The outcome , before the hearing, was obvious and another example of how special interest enjoys playing on the government playground. Is it honorable for a stockholder in a corporation to vote on legislation benefiting personal interest?   Isn't that why Phil Hamilton, Ex Delegate NN, is in Prison?  Where are the investigators?"
