The lawsuit filed in Baltimore's Federal District Court underscores the grave issues continuing to plague Maryland's electoral system and processes - demands action and reform
CHANTILLY, VA - October 27, 2014 - Virginia Voters Alliance announces today that a Federal lawsuit was filed in Baltimore's Federal District Court that provides unassailable proof for the long-suspected claims that non-citizen voters are playing a significant role in statewide voting processes in Maryland. Specifically, as the deciding votes in recent election outcomes have traditionally been very close, non-citizens who are continually permitted to vote are in a position to dramatically alter and affect the electoral process in the state and nation at large.
In this latest lawsuit filing, the Frederick County Clerk's office admitted that several individuals, despite swearing they are non-citizens and therefore rendering them ineligible to serve as jurors in legal proceedings, continue to remain on the state's voter rolls. Their continued appearance on these lists makes it nearly impossible for Maryland law to prevent these declared non-citizens from casting votes in elections and significantly affecting the integrity and outcomes of overall electoral processes.
In addition to the serious impacts non-citizen voters have to affect election outcomes, allowing these individuals to register to vote and retaining them in the voter roll opens up the possibility of non-citizens serving on a jury, which could seriously jeopardize a defendant's right to a fair trial by a jury of his peers.
Under the terms of this latest lawsuit, the United States District Court in Baltimore, Maryland is asked to prevent non-citizens from voting in Frederick County, however it does little to establish processes to guard against this occurring in the state's other 22 voting jurisdictions. Based on the number of potential unqualified voters identified in Frederick County, Maryland, VVA has extrapolated the number into densely-populated counties, that have in effect become 'sanctuary' cities and counties, to account for 3.5 to 7% of legal voters registered in Maryland.
As a state with a significant Democratic majority, these recent incidences, and the continued appearance of known non-citizens on its voter rolls underscore the grave state of Maryland's electoral integrity processes and approach. Currently, voter fraud in Maryland is only prosecuted as a misdemeanor charge, a relatively minor punishment alarmingly similar to a wrist slap, nothing more. To-date, the Maryland State Board of Elections has not been aggressive in investigating and prosecuting duplicate voter registrations and duplicate voters between Virginia
and Maryland. This overall apathetic response and lack of action presents further proof that
eliminating duplicate and illegal voter registrations are largely inconvenient to policymakers'
agendas. The Maryland County Council also recently convened a "Right to Vote Task Force,"
whose recommendations threaten to further erode election integrity in the state, as well as approve
flagrant violations of federal law and the U.S. Constitution if allowed to be passed and
implemented.
"Maryland as well as Virginia has repeatedly prioritized election convenience by sacrificing
election integrity," VVA President, Reagan George said. "Registration forms that only require a
checked box to determine something as important as qualifying citizenship is hard to track and is
easily ignored or discounted. Proof of citizenship to register should be mandatory, especially when
being a non-citizen can impact jury pools and possibly criminal cases. This issue is critical to the
future of the integrity of our electoral processes, in Maryland and nationwide."
